DECLARATION OF ELLEN THOMAS IN SUPPORT OF
PLAINTIFFS' MOTION TO STRIKE
RANDY MEYERS' LETTER OF JANUARY 20, 1995
FROM THE RECORD

I, Ellen Thomas, hereby declare under penalty of perjury that the following is true and accurate to the best of my knowledge and recollection:

1) On January 13, 1995 I was attending my signs in Lafayette Park.

2) Around 3:30 p.m. I noticed an unidentified police officer taking pictures of my signs.

3) The officer apologized to me for taking pictures. He said, "Ms. Thomas, I'm really sorry, but I'm supposed to take pictures of your signs. I was told there is going to be a trial on Tuesday."

4) Although the officer was incorrect about "a trial on Tuesday," I am almost certain that the photographs attached to Mr. Meyers' letter of January 20, 1995 are the ones taken by the unidentified officer on January 13th.
