DECLARATION OF ELLEN THOMAS RE INCIDENTS AFTER CLOSING OF PENNSYLVANIA AVENUE, MAY 1995

I, Ellen Thomas, do hereby declare under penalty of perjury, that the following is true and accurate to the best of my knowledge and recollection,:

1. On or about May 22, 1995, two days after Pennsylvania Avenue was closed to vehicular traffic, I was approached by a Park Police officer who was not wearing a nametag, who said, "We're wondering why you and Mr. Thomas haven't moved your signs into the street." Somewhat startled, I asked, "You mean we can?"

2. "Who will stop you?" the officer replied. He explained that Pennsylvania Avenue was under the jurisdiction of the Metropolitan Police, and that there are no regulations banning signs from the street.

3. Shortly thereafter Matteo Ferreira relieved me with the intention of staying at the signs to talk to the public for several hours. I told Matteo about my conversation with the Park Police officer. I also told my husband, William Thomas.

4. My husband, Thomas, later videotaped Matteo moving the signs into the street. Shortly thereafter three Secret Service officers told him to put the signs back up on the sidewalk or risk arrest. He put the signs back up on the sidewalk.

5. On May 26, 1995, my husband was arrested after moving our sign to the center lane of Pennsylvania Avenue, the same sign ("Wanted, Wisdom & Honesty" on one side, "Trust God and Disarm Everywhere" on the other side) that has remained, immediately east or west of the center of the south sidewalk of Lafayette Park, since he and I painted it in August, 1994.

6. Although the sign is somewhat cumbersome, I routinely move it by myself, without help from anyone.
