SUPPLEMENTAL CRIMINAL INCIDENT RECORD

El47 RESULTS OF INVESTIGATION

_ At 11:00 A.M., Mr. Thomas-climbed up a tree in the park and attached a hammock/sleeping bag and hung a food stuffs bag from another section of the tree. He was asked by several officers to come down but he refused. At 1:45 P.M., I asked Mr. Thomas to come down and he again refused. I advised Mr. Thomas that he was in violation of the CFR regulations

_ 50.10a and 50.10c, that is, climbing a tree causing general injury to the tree, and placing attachments in the tree. At this time while I was speaking to him he was already in the tree and had his hammock/sleeping bag strung from one limb to another and a food stuffs bag and coat hanging from other limbs. Mr. Thomas told me that I was paid to do a job and I should do it. At this time with the assistance of a ladder I reached the lower branches of the tree and began to climb to the upper branches of the tree where Mr. Thomas had perched himself. The more I advanced up the tree, the more Mr. Thomas moved upward. Finally when I was in reach of~him, he leaped from one section of the tree to another section eight feet away. At this time with the assistance of other officers, Mr. Thomas was forced to lower branches where he was taken into custody. While I was still in the tree, I saw several branches broken in addition to several branches broken by him when he was leaping from one branch to another. After I returned to the ground, Mr. Thomas was charged with Title 18 USC slll, resisting arrest.
