RECEIVED
MAY 9 1988
CLERK OF THE UNITED
STATES COURT OF APPEALS
UNITED STATES COURT OF APPEALS
FOR THE DISTRICT OF COLUMBIA CIRCUIT
PHILIP JOSEPH, Appellant,
versus U.S. App. No. 88-3031
UNITED STATES OF AMERICA, Appellee.
MOTION TO RESCHEDULE FILING DATES
On March 3, 1988 Deputy Clerk, Carmen A. Gooding entered
an Order on behalf of this Court which instructed the Appellant
to file certain documents on or before April 4, 1988.
Appellant was unable to comply with the April 4, 1988 filing
date because he did not receive MB. Gooding's Order until May
2, 1988.
One of the enclosures in Ms. Gooding's correspondence was
a manilia envelope bearing two stamps: a Court Of Appeals date
stamp, March 14, 1988, and a D.C. Jail stamp; "NO RECORD
FOUND RETURN TO SENDER." Exhibit 1, attached hereto. Appellant
presents Exhibit 1 as some indication as to why the Order did
not reach him in a timely fashion.
THEREFORE Appellant moves for an extension of time up to
and including June 6, 1988 within which to file:
1. A copy of the Decision of the District Court.
2. Statement of Issues to be Raised on Appeal.
3. A report certifying that all necessary transcripts have
been ordered.
Respectfully submitted,
