AFFIDAVIT OF JAMES C. LINDSEY

I, James C Lindsey, pursuant to 28 U. S.C..Sec 1746 depose and say as follows:

1. I am the Claims Specialist for the National Capital Region of the National Park Service I have held this position since September 1. 1985. As Claims Specialist. I am responsible for the administrative investigator of all claims submitted under the provisions of the Federal Tort Claims Act resulting from incidents occurring in areas under the administration and control of the National Park Service and/or incidents involving agency employees, including officers of the U. S. Park Police, in the performance of their official duties. I maintain the subject claim and claim inquiry files.

2. The files that I maintain on all claim inquiries and claims received by the National Capital Region National Park Service, have been searched and I

verify that there is no record that the Plaintiffs in this action have made an inquiry or filed a claim with this office under the provisions of the federal Tort Claims Act.
