REPLY OF DISTRICT OF COLUMBIA
TO SUBMISSIONS OF PLAINTIFFS

Defendant District of Columbia submits that plaintiffs have submitted nothing which addresses its arguments that the case against it must be dismissed under the statute of limitations. Nor has plaintiff specifically countered the other arguments made by the District of Columbia in its initial Motion To Dismiss. The District of Columbia does note that in view of the very recent U.S. Supreme Court Decision in Owens v. Okure, _ U.S. _ , 57 LW 4065 (Jan. 10,1989) the District of Columbia no longer maintains that a one year statute of limitations should apply to suits under 42 U.S.C. §1983 and acknowledges that a 3 year statute of limitations is appropriate. As noted in its original motion, however, since the acts involving the District of Columbia alleged herein all occurred in March of 1983, more than 5 1/2 years before the filing of suit herein, the claims are barred under a 3 year statute of limitations.
