WHEREAS, plaintiffs have raised an issue of intent with respect to certain incidents that occured on March 11, 1983, and

WHEREAS, defendants, or their legal counsel, have countered with a defense that appellant Thomas was convicted of "criminal damage" with respect to said incidents of March 11, 1983, and

WHEREAS, appellees have previously purported that no further litigation was pending with respect to Thomas' conviction which arose from said incidents of March 11, 1983, appellants hereby move for judicial notice of the attached Opinion in Thomas v. United States, App. No. 87-1728, entered by the District of Columbia Court of Appeals on April 19, 1989.
