PLAINTIFFS' MOTION FOR A WRIT OF MANDAMUS

On or about June 13, 1990, agents of the United States Park Police seized two flags from plaintiff Concepcion Picciotto.

Although defendants' agents have shown no probable cause for the seizure of those flags, the United States Park Police still retain possession of plaintiff Picciotto's flags.

Therefore plaintiffs hereby move this Court to issue a Writ of Mandamus in order to compel defendants' to return plaintiff's flags to her possession.

For the Court's convience a proposed Writ is attached.

WRIT OF MANDAMUS

Upon consideration of plaintiffs' Motion for a Writ of Mandamus, defendants' opposition thereto, and the entire record of this case, this day of September, 1990, plaintiffs motion is hereby GRANTED, with the mandate that:

the United States Park Police shall, forthwith and with all possible haste, return to Concepcion Picciotto the two flags which its agents (Sgt. Gentile, Officer Bacon, et. al.) seized from her on or about June 13, 1990, by delivering them into her custody at Lafayeete Park, the site from which they were seized.
