In light of the fact that the Court's primary -- or at least the first reason noted -- ground for denying plaintiffs' motion for a preliminary injunction to stay criminal prosecution was that "the government states that it does not yet know whether a criminal prosecution for the alleged violation will be undertaken" (Order filed July 19, 1990), plaintiffs would like the Court to know that the government has definately decided that a criminal prosecution will be undertaken. Exhibits 1 & 2.
