ORDER
On September 5, 1991, plaintiffs filed a motion for production
of transcripts without cost, seeking transcripts of proceedings for December 5, 1988; January 9, 1989: September 11 1989; and December 7, 1989. Upon receipt of plaintiffs' motion, the Court informed plaintiffs that although hearings were held in open court on December 5, 1988; January 9, 1989: and December 7, 1989, there was no record of a September 11, 1989 proceeding.
On September 9, 1991, plaintiffs filed what they term a "motion for reconsideration," indicating that they had erred when they requested the transcript of a hearing held on September 11, 1989 and seeking transcripts of a proceeding held on September 12, 1991.
Accordingly, it is hereby
ORDERED that having determined that the appeal is not frivolos and presents a substantial question, as is required by 28 U.S.C. § 753(f), the court reporter shall prepare and furnish to plaintiffs transcripts of the September 12; 1989 proceedinges;
it is
FURTHER ORDERED that the fees for such transcripts shall be paid by the United States pursuant to 28 U.S.C. § 753(f).
IT IS SO ORDERED.
