O R D E R
On November 14, 1991, federal appellees filed a motion
for summary affirmance. Any response was due on or before November
25, 1991. Appellant William Thomas submitted an opposition to
the motion on November 25. Appellants Ellen Thomas, Concepcion
Picciotto, Mary Huddle and Scott Galindez, however, did not submit
any response to the motion for summary affirmance, but have all
requested that counsel be appointed and that extensions be granted
to enable them additional time to respond to federal appellees'
motion. Upon consideration of the foregoing, it is
ORDERED that the extension requests be granted.
All appellants, who have not yet responded, shall file any response
to the motion for summary affirmance within thirty (30) days of
the date of this order.
Appellants Ellen Thomas, Concepcion Picciotto, Mary Huddle
and Scott Galindez have each indicated the need for additional
time to secure attorney(s) to represent them in this appeal. Appellants
should be aware, however, that the filing of a motion for appointment
of counsel does not relieve them of the obligation to file a timely
response to any motion filed by appellees. Appellants who have
not to date responded to the motion for summary affirmance should,
therefore, respond within thirty (30) days of the date of this
order, whether or not they have secured the assistance of counsel
by that date.
The Clerk is directed to send a copy of this order to appellant
by certified mail, return receipt requested, and by first class
mail.
