MEMORANDUM IN SUPPORT OF
PLAINTIFF'S MOTION TO CORRECT DOCKET ENTRIES

On June 20, 1997, plaintiff filed with the Court his Proof of Service with attached Declaration of Service as to all defendants in this case. The Declaration stated with regard to service upon defendant Christian Stanton:

On April 18, 1997, at approximately 4:27 p.m. at the Legal Division, U.S. Secret Service, 1800 G Street, N.W., 8th Floor, Washington, D.C., I handed a copy of the Complaint in this case and a Summons addressed to Ofc. Christian Stanton to a person previously known to me as Mary Beth Wolfe, who identified herself to me as Mary Beth Delucca, and who said she was authorized to accept service of process on behalf of Ofc. Stanton.

Based upon plantiff's Proof of Service, the Clerk of Court made entries on the docket, numbering 2 and 3 respectively, reflecting service upon the U.S. Attorney on April 22, 1997 and upon the U.S. Attorney General on April 21, 1997. The Clerk failed to make any entry on the docket regarding service of the summons and complaint upon defendant Christian Stanton.

The record in this case should be corrected to reflect service upon defendant Christian Stanton on April 18, 1997, according to the Proof of Service filed June 20, 1997. Plaintiff's motion should be granted.
