Washington, DC. 797-4632 Mr. Cowgill Assistant U.S. Attorney Superior Court for the District of Columbia August 4, 1989 Dear Mr. Cowgill: On July 31, 1989 I was in the Superior Court for the purpose of pressing charges against an individual known to me as Marc A. Palmer. This name may be an alias. On the docket he was listed as Marc A. Harris, and it seems unlikely that a man who behaves as Mr. Palmer does just suddenly entered into a life of crime on 5-21-89 However, this individual is on record as Marc Palmer. See enclosure. I found it extremely disturbing that, although the police had statements from three witnesses in addition to myself, the charges against Mr. Palmer were dismissed. When I expressed my disatisfaction over the dispositon of the matter, Mr. Kruger, who was representing the government in the case, said that the decision not to prosecute had been made on a supervisory level and there was nothing he could do about it. This is not the first time I have experienced problems with this Mr. Palmer, nor it is the first time that I have experienced difficulty in obtaining assistance from your office in dealing with these problems. See, enclosure at #'s 01 and 02. From my personal knowledge Mr. Palmer is involved, on perhaps a daily basis, either in thefts or assaults. Once, I personally saw him bite a chunk out of a man's lip after the man complained that Mr. Palmer had stolen his bicycle. I consider Mr. Palmer a serious danger both to people and property. In fact, on July 31st, immediately after he was released from custody, Mr. Palmer made threats of violence against two of the witnesses who signed statements against him. He stated that while he had been in custody the marshals told him to "kick their asses," and bragged that if he went to jail he would be released again. In light of the facts that your office is ostensibly in business to insure the public's protection from theft and violence, and that Mr. Palmer has been running up an impressive record for theft and violence since at least as early as 5-21-89, I would like to know why your office is refusing to prosecute him.
