William Thomas P.O. Box 27217 Washington, D.C. 20038 (202) 462-0757 July 11, 1991 Sarah Cutler Dear Sarah: I believe that our interests are similar in that we both seek a healthy democracy through accountability under law. It seems our difference in approach is exemplified by our projects. As I understand it your focus is to draw attention to evidence of official contempt for Article II. My focus is to utilize Article V to cause a change through the unification and empowerment of individuals. You asked me whether I thought that your efforts to draw attention to the administration's rough-riding over Article II was a waste of energy. In the sense that any intelligent efforts to cause thinking people to consider the inequities and absurdities of the current state of law is, in my opinion, a worthwhile endeavour. But, while your efforts may well prove thought provoking, the practical effect of your enterprise is not readily apparent to me. First it seems that -- since the crisis is past -- both congressional irresponsibility and/or administrative imperialism have, from a legal perspective, become moot points. Hence, your labors may amount to little more than academic exercise. Second, assume you succeed in focusing attention on the reason and logic inherent in Article II, and illustrate that under the circumstances existing around January 12, 1991 the letter and spirit of the law should have precluded the administraion's actions. Still, I think, next time the security zealots will simply claim that the circumstances surrounding that future situation are different, and so they will be free to rehash the same debate while they go right ahead with their nefarious schemes. You have helped us, it is only right that we should help you. But if you could shed some light on my questions. it might be easier for us to think of some way in which we might be of assistence to you in your project. God help us, Thomas
