NOTICE OF APPEAL

Pursuant to Fed. R. Civ. Pro. 4, Notice is hereby given this 20th day of October, 1996, that William Thomas, Proposed Intervenor in the above entitled action, hereby appeals to the Eleventh Circuit Court of Appeals from the final Judgment of this court entered on the 20th day of August, 1996, in favor of plaintiff United States and against "all named defendants who have been served but have failed to file a responsive pleadings to the complaint." The final judgment implicates rights and privileges guaranteed Proposed Intervenor under the Constitution of the United States, and, with all due respect, the district court's refusal to permit intervention by the undersigned was an error.
