ORDER
Plaintiff has filed a notice of appeal from the Magistrate's
order moving the trial date from October 20, 1986 to December 15,
1986. Postponement of the trial is necessary to permit a full
and fair consideration of the issues raised by defendants' motion
for summary judgment, A decision on that motion could have a
real
significant inpact on the nature and scope of the trial and
interests of fairness and judicial economy require that the
motion
be decided prior to the start of trial. This decision cannot be
rushed. Contrary to Plaintiff's contention, this is not a simple
case and defendants' motion cannot be dispatched forthwith.
Accordingly, it is this day of October, 1986, hereby
ORDERED: that the Magistrate's order filed October 8, 1986,
rescheduling the trial to start December 15, 1986, should be,
and hereby is, AFFIRMED.
