NOTICE OF SECOND FILING OF DECLARATIONS
On September 22, 1986, as reflected by the Clerk's date stamp
which appears on the first page of the photocopies attached to the
Clerk's copy of this Notice, plaintiffs filed four separate
Declarations, which were listed on the Certificate of Service as
documents numbered 4 (Second Declaration of William Thomas), 5
(Declaration of Ellen Thomas), 6 (Declaration of Robert Dorrough),
and 7 (Declaration of Charles Hyder).
The docket sheet does not reflect these documents on the
Record, although they are also identified in Plaintiffs' List of
Trial Exhibits as Trial Exhibits 146 (e), (f), (g), and (h).
A review of the jacket on file with the Clerk's office failed
to reveal any indication that these Declarations had been included
in the Record. Furthermore, an inquiry to Digit Clerk Kathy
Snuffer provided no insight as to how or why these Declarations had
not been included in the Record.
Therefore, plaintiffs hereby re-submit the Declarations of
William Thomas, Ellen Thomas, Robert Dorrough, and Charles Hyder.
