PLAINTIFF'S NOVEMBER 21, 1986 MOTION
FOR JUDICIAL NOTICE
At the Summary Judgment hearing held by the Magistrate on
November 14, 1986, both Mr. Martinez and Ms. Staempfli made fairly
definitive-sounding representations to the effect that no appeal
was pending in the "criminal damage" case.
To lay to rest any misunderstandings which may have arisen
on the record due to defense counsels' erroneous representations,
plaintiff hereby appends the Notice of Appeal which has been filed
in USA v. Thomas, DCSupCt F-1453-83, and requests that the Court
take Judicial Notice of these facts.
