MEMORANDUM IN SUPPORT OF
PLAINTIFFS' MOTION
FOR A STATUS HEARING
As the Court is aware trial is set for this matter on
December 15, 1986.
On November 14, 1986 Magistrate Burnett held a hearing on the
defendants' Motions for Summary Judgment, pursuant to orders of
this Court.
The Magistrate set a target date of December 5, 1986 by which
to file the recommendation on the motions as directed by this
Court's order.
Pending the Magistrate's recommendation, plaintiffs have yet
to issue subpoenas.
As the Court also knows there are a number of issues pending
with respect to discovery and the issues in the case.
Particularly plaintiffs feel that their Opposition to Federal
Defendants' Motion for Judgment on the Administrative Record, filed
September 22, 1986, must be considered in this action. As recent
events testify (see: Motion for Joinder of Claims Against Lt. Hugh
Irwin, filed November 20, 1986), plaintiffs have good cause to
believe that this regulation will be selectively enforced against
them, for no good reason.
Assuming the Magistrate hits the December 5, 1986 date, that
will leave ten days until the trial.
This short interval will not, plaintiffs fear, allow enough
time to prepare properly for trial.
Therefore plaintiffs request that the Court set a status
hearing to reschedule the proceedings in this matter.
