REPLY TO APPELLEES' MOTION TO DISMISS APPEAL

Although:
"As grounds for (their) Motion, Appellees state that the Court lacks jurisdiction because Appellant did not file a Notice of Appeal pursuant to Rule 3 and 4...." (Motion to Dismiss, top of page 1.)

Appellees also make the factually correct, albeit grammatically questionable, representation that:

"Appellant has has (sic) filed a notice of appeal with the Clerk of the Superior Court. " (Motion to Dismiss, bottom of page 1.) (See Attachment A hereto.)

CONCLUSION

Since it is apparent from Attachment A that Appellant did file a notice of appeal on April 25, 1986 (see Response to Appellees' Opposition to Motion for Summary Reversal filed this date, p. 1), Appellees lack any grounds for this Motion to Dismiss and Appellant therefore respectfully requests the motion be denied.
