Washington, D.C. 20001
Dear Mr. Thomas:
This letter is in response to your May 23, 1994, Freedom of
Information Act (FOIA) request for a "log of the public comment
received by the agency with regard to that proposed rulemaking."
The "proposed rulemaking" mentioned in your letter referred to a
Forest Service proposal to amend 36 C.F.R. 251 & 261 that was
published in the Federal Register on February 16, 1994.
In response to your request, we have conducted a careful search
of our records and determined that there is no document that is
responsive to your request. The search was exhaustive and
reasonable.
To the extent that we have no records responsive to your request,
the Freedom of Information Act provides you with the right to
appeal this determination. Any appeal must be made in writing to
the Chief, USDA Forest Service, P.O. Box 96090, Washington, D. C.
20090-6090, within 45 days from the date of
this letter. The term "FOIA APPEAL" should be placed in capital
letters on the front of the envelope.
Sincerely,
LAMAR BEASLEY
Deputy Chief for Administration
